Long time, no see. I did a search and couldn’t find much so I’m turning to all you for some help. Especially important since when the X2 asked me about the following, I told her I didn’t know but I was certain 2Cool could help.
Here’s the best condensed version I can provide:
My wife, Gabri, is a very successful coach for Beachbody. She’s been a coach for a little over two years. Like most in her business, she utilizes Facebook as her primary marketing tool. Her coach “page” is simply titled, Coach Gabri Means. She refers to her coaches (those signed under her) as Team Infinity and refers to all of her customers and coaches as Infinity Fit Club. She has Facebook “groups” titled Infinity Fit Club and Team Infinity. She regularly uses the hashtag, #TeamInfinity on any posts that are related to her team.
Earlier this evening, she received the following Facebook message from another Beachbody coach:
(condensed) [ Hi, my name is xxx and I’ve been a coach for almost 4 years and I’m the leader of Team Infinity. I was doing a search and saw some of your posts. I’ve been using this name for 3 years and I request you stop using it and find another name for your group. I trust you’ll stop using this name. ]
We’re in Hockley, Texas. This other lady is in Oregon. Gabri looked her up and found her Facebook “page” is titled Infinity Fitness which is different than Infinity Fit Club but we saw that the other coach also uses the hashtag, #TeamInfinity. Do you see where this other coach has any legal standing to prohibit the use of a hashtag?
I hate that this ran long, but I hope you understand what I’m asking. I would imagine that there is nothing anyone can do about the use of a hashtag or a title like this as neither are actual business names. Do I actually need to consider trying to trademark “Team Infinity”?
