Question about broken costas

I have a pair of Jose's that I've had for a few years. After the few years of use, and a 2 year old pulling the arms apart, the left arm is bent out when opened and is took more and won't fit behind my ear. Now I know I can send them in, question is, you think the hinge being bent out be under warranty? I got a new pair so I don't HAVE a to have these fixed, but it would be nice to have a back up that I can wear. But if I have to spend $100 on a new hinge, not worth it. I don't have a problem sending it in, but just thought to see if yAll have had any experiences with their repair department
